These Terms & Conditions (“Terms”) govern your use of anavahdesignstudio.ca (the “Site”) and any services provided by Anavah Design & Studio (“we”, “us”, “our”). By accessing the Site or booking services, you agree to these Terms. If you do not agree, do not use the Site or services.
1. Services
We provide photography and interior design services, including consultations, virtual services, and in-person sessions. Specific deliverables, timelines, and inclusions are defined in your proposal, invoice, booking confirmation, or written agreement.
2. Bookings & Payments
- Deposits: Deposits (if applicable) are non-refundable and secure your booking date/time.
- Payment due: Unless otherwise agreed in writing, payment is due as specified on your invoice/booking terms.
- Methods: We accept cash, e-transfer, and payment through Bloom (or other listed payment platforms).
- Late arrivals: Session time may be reduced if you arrive late. Additional late fees may apply where stated in your booking policies.
3. Cancellations, Rescheduling & No-Shows
Cancellation and rescheduling terms may vary by service type and will be stated in your booking policy or agreement. If you cancel same-day or fail to attend without notice, you may be charged the full service amount due to limited availability.
4. Client Responsibilities
To ensure a smooth experience, you agree to:
- Provide accurate information and respond to requests needed to complete your project.
- Arrive on time for sessions and be prepared (e.g., outfits, props, access to location).
- Obtain any necessary permissions for locations, venues, or third-party properties.
- Review deliverables and provide feedback within a reasonable timeframe.
5. Creative Direction & Revisions
Our work is creative by nature. We will use professional judgment in style, composition, and design decisions. Where included, revision rounds are limited to what is stated in your package/proposal. Additional revisions may be billed.
6. Delivery Timelines
Estimated delivery timelines (e.g., galleries, edited images, design boards/renderings) depend on your package and the scope of work. Timelines may begin once required selections, approvals, measurements, or inputs are received from you.
7. Intellectual Property & Usage
- Ownership: Unless otherwise agreed in writing, we retain copyright to original photography and design materials we create.
- Client license: You receive a license to use final delivered materials for personal and/or commercial use as specified in your booking/package terms.
- Raw files: Raw/unedited files are not included unless explicitly stated and may be available for an additional fee.
- Portfolio use: We may display work for portfolio and marketing purposes unless you request otherwise in writing (where permitted by law).
8. Third-Party Products & Purchases (Interior Design)
For interior design services, we may recommend third-party vendors, furnishings, or contractors. We are not responsible for third-party performance, manufacturing defects, shipping delays, or warranty claims. Purchase terms, returns, and warranties are governed by the vendor.
9. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Site or services. Our total liability for any claim will not exceed the amount paid by you for the specific service giving rise to the claim.
10. Warranty Disclaimer
The Site and services are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, except where such disclaimers are not permitted by law.
11. Website Use
- You agree not to misuse the Site, attempt unauthorized access, or interfere with Site security or functionality.
- Content on the Site may not be copied, reproduced, or redistributed without our written permission, except as permitted by law.
12. Governing Law
